OSHA Temporarily Stays Vaccine Mandate

Requirement for employers of 100+ workers paused by court order.

On November 12, the Fifth Circuit U.S. Court of Appeals granted a motion to stay the Occupational Safety and Health Administration’s (OSHA) COVID-19 vaccination mandate for businesses of 100+ employees. The suspension was due to the court’s view that enforcement of the constitutionally questionable requirement must pause while the litigation process plays out.

OSHA announced it would comply with the court order this past Wednesday. OSHA stated, “While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.” 

The Sixth Circuit U.S. Court of Appeals has been allotted the responsibility to decide the merits of the cases challenging OSHA’s Emergency Temporary Standard that mandates the vaccine for companies employing 100 or more workers.
